Why can a license be suspended in Detroit due to traffic tickets?

In Michigan, drivers are assessed points for various Michigan traffic violations. The points are assessed if you plead guilty or if you are found guilty after a hearing. There are suspension consequences for accumulating too many points as follows:

  • 4 or more points. You’ll receive a warning letter from the Michigan Secretary of State.
  • 8 or more points. You’ll receive a second warning letter from the Michigan Secretary of State.
  • 12 or more points. You’ll be asked to take a driver reexamination test. The test will examine your vision, examine your knowledge of Michigan’s traffic laws, include an on-road test, and request appropriate medical and vision records.

As a result of the reexamination you could:

  • Receive a restricted license that has specific conditions such as the requirement to install and use an ignition interlock device (IID) that tests your blood alcohol content.
  • A suspension of your license for a specific time period.
  • A suspension of your license until you complete certain specific requirements. A first OWI/DWI/DUI offense will result in a license suspension of six months. If your BAC was .17 or higher or you refused to take a BAC test if the officer suspected a DUI – the license suspension is for 12 months.

The points stay on your record for two years after the date of your convictions. Points can also include off-road vehicle and snowmobile violations.

According to the Michigan Department of State, the points are assessed as follows:

  • Two points. Drivers are assessed two points for:
    • Driving with an open container of alcohol such as a beer can in their vehicle
    • All moving traffic violations that aren’t assessed with a higher point total
    • Refusing to take a breath test if they’re legally pulled over and they’re under 21
  • Three points. Drivers are assessed four points for:
    • Driving carelessly
    • Driving between 11 and 15 mph over the speed limit
    • Not obeying stop signs or traffic signals
    • Failing to stop at a railroad crossing
    • Not complying with school crossing guard instructions
    • Not stopping for a school bus
    • Passing improperly
  • Four points. Drivers are assessed four points for:
    • Driving while visibly impaired
    • Drag racing
    • Having any alcohol on a blood alcohol test if the driver is under 21
    • Driving 16 mph or more over the speed limit
    • Failing to yield or use caution for emergency vehicles.
  • Six points. Drivers are assessed six points for:
    • Various felonies that involve the use of a vehicle
    • Manslaughter or negligent homicide [Not sure if this requires a vehicle?]
    • Driving under the influence of alcohol or drugs
    • Having a BAC of .08 or higher
    • Reckless driving
    • Refusing to take a chemical test if suspected of drunk or drugged driving
    • Fleeing or eluding a police officer.

Your license can also be suspended if you fail to comply with any insurance laws.

Eligibility for a BDIC depends on several factors. You’re eligible if you meet the following conditions:

  • You have a non-commercial Michigan driver’s license.
  • You only have at most two points on your driving record.
  • The traffic offense did not involve a criminal offense
  • The traffic offense did not involve driving a commercial motor vehicle
  • The offense/ticket is for an eligible offense – for example, is three points or less and is not for careless of negligent driving.

Generally, the course costs up to $100 and takes about four hours. There are online and in-classroom courses. The course must be offered by an approved sponsor. You still need to pay any fines or court costs associated with your ticket. There is generally a 60-day time limit for taking and completing the course.
