Why should I hire a traffic defense lawyer instead of paying the ticket?

Michigan uses a point system to track your driving record. If you acquire 12 or more points, your license could be suspended or revoked. Generally, traffic violations are assigned a score of 2, 3, 4, or 6 points. If you have 4 points, you’ll receive a warning letter. If you have 8 points, you’ll receive another warning letter. Yearly assessments may be applied if you have 7 or more points. The points for each violation stay on your record for 2 years.

A conviction of a traffic offense means more than just points. Each violation carries fines and court costs. The fines increase with the severity of the offense. Misdemeanor and felony traffic offenses can result in imprisonment.

For many drivers, the biggest expense is that their insurance premiums will dramatically increase because insurance companies worry that drivers who have points on their driving record are not safe drivers – they’re risky. The increased rates will normally continue as long as you have points on your record. Other factors that can affect your premium are whether you were involved in an accident, whether anyone was injured, whether there was damage to any of the vehicles, and your prior relationship with the insurance company,

The Michigan point system assigns points (2, 3, 4, or 6) depending on the severity of the offense. Some of the many types of traffic tickets in Detroit that will result in points include:

  • Two points. Traffic tickets in Detroit that will result in two points include driving with an open alcohol container, drivers under 21 who refuse a preliminary breath test, and all moving traffic violations that don’t have higher point totals.
  • Three points. Traffic tickets in Detroit that will result in three points include speeding at 11-15 mph over the speed limit; failing to stop at railroad crossings, traffic signs, traffic signs, a school bus, or before a crossing guard; driving carelessly; and passing improperly.
  • Four points. Traffic tickets in Detroit that will result in four points include any positive blood alcohol test result if a driver is under 21, speeding at 16 mph or more over the speed limit, failing to yield or exercise caution for emergency vehicles, drag racing, and driving while visibly impaired.
  • Six points. Traffic tickets in Detroit that will result in six points include felonies that involve using a motor vehicle, operating while intoxicated or under the influence of drugs, refusing a chemical test, failing to give the necessary ID after an accident, reckless driving, a BAC of .08 or more, and fleeing or eluding a police officer.

As mentioned, if you have 12 or more points, your license will be suspended.

How do you fight for traffic ticket defendants?

If you meet the eligibility requirements, you should be able to take a Basic Driver Improvement Course (BDIC). On completion of the course, the traffic ticket is placed on your driving record – but not the points.  The ticket information is not disclosed to the insurance companies.

Eligibility for a BDIC requires that you have a valid non-commercial Michigan driver’s license. The ticket can’t involve a criminal offense (a misdemeanor or a felony). Your driving record (without the new ticket) must have at most two points. The current ticket is only for offenses that would assess no more than three points.

There is a fee for the course which takes about four hours to complete (online or in a classroom).
