Why are licenses suspended or revoked in Michigan?

According to the Michigan Department of State, if your license is suspended, your right to drive is normally suspended for a specific period of time. When the suspension period is over, you can seek to have your license reinstated at a local Secretary of State Branch office. This normally involves showing the office that the suspension period is complete, paying the appropriate fees, and showing that you have the required insurance coverage. If the suspension was for an indefinite period, additional conditions may need to be met such as showing that you used an Ignition Interlock Device (IID) for a specific length of time.

According to the Michigan Department of State, if you license is revoked, the driver’s right to drive is completely terminated. Your license can only be restored if you meet the eligibility requirements and the Michigan Department of State approves your license restoration – after a formal hearing.

Suspensions and revocations due to point totals of 12 or more

Points are added to your driving record based on the severity of the motor vehicle offense. If you acquire too many points, your license can be suspended or revoked. The points to your driving record are added as follows:

  • Two points. Drive with an open alcohol container, refuse a preliminary breath test if you’re under 21, and all traffic violations not covered by the higher point schedules.
  • Three points. This amount is added if you drive carelessly, drive 11-15 mph over the speed limit, fail to stop at a railroad crossing, pass improperly, fail to comply with a stop sign or traffic signal, or fail to stop for a school bus or disobey a school crossing guard.
  • Four points. This amount is added if you drive while visibility impaired, drag race, have BAC positive reading if you’re under 21, drive 16 or more miles over the speed limit, fail to yield or use caution for emergency vehicles.
  • Six points. This amount is added for various felonies (manslaughter, negligent homicide, or other felonies that involve using a motor vehicle), operating a vehicle under the influence of alcohol or drugs, failing to give the requisite identification after a crash, reckless driving, a blood alcohol test result of .08 or higher, refusing to submit to a chemical tests, and fleeing or eluding a police officer.

If your license is suspended, you will normally lose your driving privileges for a period of months. If your license is revoked, you will need to wait between one to five years to apply to have your license restored.

These requirements include showing that some legal right was violated, the decision wasn’t supported by the evidence, and other factors.
